1. Background

1.1 Patient Flow Pty Ltd (ABN: 89 648 250 024) operates ApolloScribe — a clinical documentation platform that enables Patient Users to complete pre-consultation health checks, receive appointment communications, and receive AI-assisted clinical summary letters ('Patient Letters') following their consultations, and related services.

1.2 These Terms apply to Patient Users accessing the Platform. Defined capitalised terms are set out in section 15.

1.3 By accessing the Platform, you agree to be bound by these Terms and the Privacy Policy, as amended from time to time.

1.4 ApolloScribe may amend these Terms by publishing updates on its website or notifying users via email or Platform notification.

2. Your access to the platform

2.1 Access is granted on the condition that you comply with these Terms and any reasonable requests from ApolloScribe.

2.2 You receive a limited, non-exclusive, and revocable licence to access and use the Platform, with potential additional terms at ApolloScribe's discretion.

3. Account registration

3.1 Platform access requires accepting these Terms via consent checkpoint, with registration requirements set at ApolloScribe's discretion.

3.2 Patient Users must:

  • · Verify identity with at least three forms of unique identification, including mobile number, surname, and date of birth
  • · Accept responsibility for all information entered
  • · Be at least 16 years old to hold their own account; patients under 16 may access the Platform through a parent or legal guardian acting on their behalf
  • · Allow identity verification restrictions to protect Personal and Health Information
  • · Where completing the Platform on behalf of a patient under 16, confirm that you are that patient's parent or legal guardian and that you have authority to provide their health information and provide consent on their behalf

4. Acceptable use and your obligations

4.1 You must not:

  • ·Breach laws or assist illegal acts
  • ·Infringe intellectual property or confidentiality rights
  • ·Introduce malicious code or viruses
  • ·Impersonate others
  • ·Negatively impact other users
  • ·Publish malicious content
  • ·Use the Platform vexatiously
  • ·Engage in unlawful, defamatory, obscene, threatening, harassing, or abusive conduct

5. Availability of the platform

5.1 While ApolloScribe takes reasonable steps to limit interruptions:

  • ·Access may be prevented by external issues beyond our control
  • ·We do not promise continuous or error-free access to the Platform
  • ·Functionality may change or improve from time to time
  • ·You can retain copies of information or contact Practitioners directly if needed

6. Third party information

6.1 The Platform may provide third-party links. ApolloScribe disclaims responsibility for linked content and for the accuracy of information provided by Medical Practices or Practitioners.

7. Data

7.1 You must:

  • ·Protect system security and privacy
  • ·Maintain the security of your access details
  • ·Immediately report any unauthorised access

7.2 While data transmission follows industry standards, you accept that the internet is not a fully secure environment and assume the risks of transmission.

7.3 Data storage follows accepted industry standards, with potential limitations.

7.4 Backups occur at reasonable intervals for business purposes; specific content recovery cannot be guaranteed.

8. Privacy

8.1 By using the Platform, you acknowledge:

  • · Collection of Personal and Health Information as described in the Privacy Policy
  • · Sharing of information with authorised Medical Practices or Practitioners
  • · Medical Practices have independent privacy policies
  • · Consent given through the Platform is valid and binding unless revoked
  • · ApolloScribe may send appointment confirmations, reminders, clinical notifications, and AI-assisted Patient Letters summarising your consultation
  • · Where your information is processed using AI, your name, date of birth, Medicare number, address, and contact details are removed before any content is submitted to an AI model — your identifying information is never transmitted to an external AI model
  • · Browsing information may be collected via cookies

8.2 Providing information about another person requires that person's consent, except where you are a parent or legal guardian completing the Platform on behalf of a patient under 16 years of age.

8.3 You must only permit another person to access your account where they are your authorised carer or legal guardian. Permitting such access means that person will be able to view Personal and Health Information associated with your account, and you consent to this.

8.4 You must promptly report any misuse or unauthorised access of Personal Information that you become aware of.

9. Pre-consultation health check

9.1 Before your appointment, you will receive a pre-consultation health check survey by email or SMS from your clinic. This survey is a core part of your care — it allows your clinician to review your health history, current concerns, and relevant background before your consultation begins.

9.2 The survey is dynamically tailored to your presenting concern and includes a review of your relevant medical history, current medications, allergies, and lifestyle factors.

9.3 You must complete the health check survey honestly and accurately. Incomplete or inaccurate responses may affect the quality of clinical care you receive. ApolloScribe is not responsible for clinical outcomes arising from inaccurate information you provide.

9.4 Your survey responses, together with any referral information provided by your referring practitioner, are used to generate a clinical summary for your clinician to review before your appointment. This summary is produced using AI. Before your responses are submitted to any AI model, your name, date of birth, Medicare number, address, and contact details are removed. Your identifying information is never transmitted to an external AI model.

9.5 Your completed survey responses are accessible to your treating clinician and authorised clinic staff involved in your care.

10. Transcription and AI-generated documents

10.1 With your consent, your consultation may be recorded and transcribed using a medical-grade speech recognition service. Your clinician is responsible for informing you that transcription will occur before it begins. You may withdraw consent for transcription at any time during your consultation by telling your clinician.

10.2 Transcription data is used to generate clinical documentation, including a consultation record held by your clinic and a Patient Letter sent to you.

10.3 Following your consultation, you will receive an AI-assisted Patient Letter by email. This letter summarises your consultation, any clinical findings or recommendations, and relevant care instructions. Before the letter is sent to you:

  • · Your consultation transcript is processed through an anonymisation pipeline — your identifying details are removed before AI processing and re-inserted into the final letter only after AI processing is complete
  • · Your clinician reviews and approves the letter before it is sent to you

10.4 The Patient Letter is a clinical summary to assist your understanding of your consultation. It is not a complete medical record, a certified clinical document, or a substitute for the advice given by your clinician during the consultation.

10.5 If you believe your Patient Letter contains an inaccuracy or omission, you should contact your clinic directly.

11. Suspension or termination of access

11.1 ApolloScribe may revoke, suspend, or end user licences and Platform access in its sole discretion.

11.2 Users are ordinarily advised of suspension or termination, but notification is not mandatory.

11.3 Upon permanent access termination, collected information may be deleted, de-identified, or retained in accordance with applicable regulatory requirements.

11.4 Termination does not affect accrued rights, indemnities, or provisions intended to survive termination.

12. Intellectual property

12.1 ApolloScribe retains all intellectual property rights in the Platform and all provided content.

12.2 You must not copy, exploit, reverse engineer, or commercialise Platform services without permission.

12.3 Where you voluntarily provide feedback, suggestions, or ideas about the Platform (for example, a bug report or feature request), you grant ApolloScribe a royalty-free licence to use that feedback for the purpose of improving the Platform. This clause does not apply to Personal Information, Health Information, or any clinical data you provide through the Platform — that data is governed solely by the Privacy Policy.

13. Liability and indemnity

13.1 You acknowledge:

  • ·Platform use is at your own risk
  • ·You are responsible for the accuracy and suitability of information you provide
  • ·We make no representation or warranty that an appointment time is actually available
  • ·The Platform is not for emergency or acute care
  • ·The Platform does not provide medical advice — all clinical decisions are made by your treating clinician
  • ·ApolloScribe is not responsible for the actions of third parties, including Medical Practices or Practitioners
  • ·ApolloScribe is not liable for illness, injury, death, or damages arising from Platform use or from clinical decisions made by Practitioners

13.2 You indemnify ApolloScribe against losses arising from any breach of these Terms.

13.3 Statutory rights under the Competition and Consumer Act 2010 (Cth) cannot be excluded. All other warranties are excluded to the extent permitted by law.

14. General

14.1 You have not relied on any representations beyond these Terms or the Privacy Policy.

14.2 Waivers require written consent; breaches are not excused otherwise.

14.3 New South Wales, Australia law governs these Terms; disputes fall under the jurisdiction of NSW courts.

14.4 Invalid clauses are ineffective without affecting the remaining Terms.

14.5 You cannot assign your agreement without written consent. ApolloScribe may assign with notice.

15. Interpretation

15.1 Defined terms used in these Terms have the following meanings:

Reminder An appointment reminder sent to a patient via the Platform

15.2 Interpretation rules include: singular and plural forms are interchangeable, grammatical variations apply, clause references include sub-clauses, legislation references include amendments, and provisions bind party successors and permitted assigns.
